1. Who is responsible for your data?
The data controller of your personal data is Sabine Bordon, an individual operating under the trading name SmartHorse, whose registered office is located at Allée du Bois de Bercuit 81, 1390 Grez-Doiceau, Belgium, registered with the BCE under number 0547.506.897 (hereinafter "SmartHorse" or "we").

2. What data do we collect?
• Identification and contact data: name, first name, delivery and billing address, email address, phone number.
• Order data: ordered products, amounts, date, order and return history.
• Payment data: payment is processed by our payment service provider. We only receive confirmation of the payment and the method used, never your complete card details.
• Exchanges with our customer service: the content of your messages, complaints, and conversations via the live chat available on the Site.
• Technical data: IP address, browser type, pages viewed and browsing data collected via cookies (see Article 7).
• Data from your customer account: username, encrypted password, preferences, and address book.
The communication of your identification, contact and delivery data is necessary for the conclusion and execution of the sales contract. Without this data, we are not in a position to process your order.
3. Why and on what legal basis?
• To process and deliver your order, manage returns and after-sales service: execution of the contract (article 6.1.b of the GDPR).
• To issue invoices and maintain our accounting: legal obligation (article 6.1.c of the GDPR).
• To respond to your questions, complaints and your messages sent via the live chat: execution of the contract or, failing that, our legitimate interest in providing good service (article 6.1.f of the GDPR).
• To ensure the security of the Site and prevent fraud: our legitimate interest (article 6.1.f of the GDPR).
• To place non-essential cookies and send you, if applicable, commercial communications: your consent (article 6.1.a of the GDPR), which you can withdraw at any time.
We never sell your personal data and do not use it for automated decisions producing legal effects concerning you.
4. Who receives your data?
We only share your data with the providers necessary for the operation of the shop, who process it on our behalf and according to our instructions:
• our online shop platform, hosting and live chat: Odoo Online, hosted by Odoo SA (Belgium);
• our approved payment service provider, who processes your payment under its own responsibility;
• our shipping platform Sendcloud B.V. (Netherlands) and the carriers responsible for delivery (bpost and DPD) ;
• our accountant, for bookkeeping ;
• public authorities, only when the law requires us to do so.
Wormiscope Kits: the sample and the form you send are addressed directly to the Laboratory of Parasitology at Ghent University, which is responsible for processing these data and communicating the results to you. SmartHorse does not have access to these information.
5. Transfers outside the European Union
Your data is generally processed within the European Economic Area. If a provider were to process it outside of this area, we ensure that appropriate safeguards are in place, such as the standard contractual clauses adopted by the European Commission. 6. How long do we keep your data?
• Invoices and accounting documents: for the duration imposed by Belgian accounting and tax legislation (10 years).
• Other data related to orders and customer service : for the duration of the business relationship, then for the time necessary for the processing of any disputes or claims.
• Conversations via live chat: for the time necessary to process your request, then for a maximum of twelve months.
• Customer account data: until the deletion of your account.
• Cookie consent data: twelve months from your choice.
7. Cookies
Our Site uses cookies strictly necessary for its operation, for example to keep your basket, maintain your session, secure payment and operate the live chat. These cookies do not require your consent.
Non-essential cookies, for example for audience measurement or advertising, are only placed with your consent, collected via the cookie banner during your first visit. You can change or withdraw your choices at any time via this banner or via your browser settings. Refusing these cookies does not affect your ability to order on the Site.
8. Your rights
In accordance with the GDPR, you have the right to access your data, to rectification, to erasure, to restriction of processing, to data portability, as well as the right to object to processing based on our legitimate interest. When processing is based on your consent, you can withdraw it at any time, without affecting the lawfulness of the processing carried out before this withdrawal.
To exercise these rights, write to us at info@smarthorse.shop. We respond within one month, extendable by two months in the case of a complex request, in which case we will inform you. We may ask you to prove your identity if we have reasonable doubts about it.
9. Complaint
If you believe that your data is not being processed correctly, you can file a complaint with the Data Protection Authority, Rue de la Presse 35, 1000 Brussels, contact@apd-gba.be, www.autoriteprotectiondonnees.be, or with the data protection authority of your country of residence. However, we invite you to contact us first: we will do what is necessary to resolve the issue.
10. Security
We take appropriate technical and organisational measures to protect your data against loss, unauthorised access or disclosure, including encryption of connections (HTTPS), hosting with a professional provider and limiting access to the data to only those who need it.
11. Minors
The Site is not aimed at minors. We do not knowingly collect data concerning persons under the age of 16. If you become aware that a minor has provided us with data, please contact us at info@smarthorse.shop and we will delete it.
12. Changes
We may update this policy, particularly in the event of changes to the Site or our providers. The current version is always available on the Site, along with its date of update. In the case of substantial changes, we will inform you by an appropriate means.
